The conditions of liabilities mentioned here do not only apply to White Whale BV, but also for the partners (listed on this website) who operate under the name of White Whale Yacht brokers advertise. These partners are completely independent companies for which White Whale BV does not bear any liability. Only the method and marketing are carried out under 1 name.

White Whale Yachtbrokers consists of several independent offices that work and collect data in almost the same way. See our “contact” menu on the website with the details of all independent offices. For each office, the first (or only) broker listed there is also the person who is the Data Protection Officer of that company. In the text below, “White Whale Yachtbrokers” means the relevant office as described above, or the head office in Willemstad.

White Whale Yachtbrokers processes your personal data because you use our services and/or because you provide them to us yourself. When requesting general information via the website or email or by telephone, we only store the data we need to contact you, no further personal data. Below you will find an overview of the personal data that we process in the case of Selling yacht owners and Buyers of ships. This is clearly stated in the relevant Mediation Agreement and the relevant Purchase Agreement. This is done, among other things, to determine the correct identity of the buyer and seller:
- First and last name
- Sex
- Date of birth
- Address
- Phone number
- E-mail address

Our website and/or service does not intend to collect data about website visitors who are younger than 16 years old. Unless they have permission from parents or guardians. However, we cannot check whether a visitor is older than 16. We therefore recommend that parents be involved in the online activities of their children, in order to prevent data about children being collected without parental consent. If you are convinced that we have collected personal data about a minor without this permission, please contact us via info@wwy.nl, then we will delete this information.

White Whale Yachtbrokers processes your personal data for the following purposes:
– Determine whether Seller is an existing person and rightful owner and whether Buyer is an existing person
– To be able to call or email you if this is necessary to carry out our services
– Safeguarding the rights and obligations that Buyer and Seller enter into with each other
– To be able to process your request

White Whale Yachtbrokers does not make decisions based on automated processing on matters that can have (significant) consequences for people. This concerns decisions that are made by computer programs or systems, without a human being (for example an employee of WWY) being involved. White Whale Yachtbrokers uses standard Office packages where your data is stored. Only employees of WWY have access to this information by means of a secure access code.

To ensure that the request for access has been made by you, we ask you to send a copy of your ID with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your
privacy. We will respond to your request as soon as possible, but within four weeks.
